Welcome to Roamer. By accessing or using the Roamer platform at roamer.travel, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.
1. Service Description
Roamer is a web-based self-guided audio tour platform. We provide free and premium walking tours with GPS-triggered audio playback, interactive maps, and multilingual content for cities in Central and South America and Mexico. Tours are designed to be used on a mobile device while walking in the tour area.
2. User Accounts
You may browse free tour content without an account. Creating an account is required to purchase premium tours. When you create an account, you agree to:
- Provide accurate and complete information.
- Keep your login credentials secure and not share them with others.
- Notify us promptly if you suspect unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
3. Free and Premium Content
Each tour offers a portion of its stops for free (approximately 30% of points of interest, with a minimum of one stop). The introduction stop is always free. Access to the remaining stops requires a one-time purchase of the premium tour.
4. Payments and Refunds
Premium tours are available for a one-time purchase price of $0.99 USD (or equivalent in local currency). All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.
Once a premium tour is purchased, access is granted immediately. Due to the digital nature of the content, refunds are generally not provided. If you experience a technical issue that prevents you from accessing purchased content, please contact us at hello@roamer.travel and we will work to resolve it or issue a refund at our discretion.
5. Intellectual Property
All content on the Roamer platform — including tour text, audio recordings, images, maps, route data, and software — is owned by or licensed to Roamer and is protected by applicable intellectual property laws.
You may use tour content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.
6. GPS and Location Services
Roamer uses your device's GPS to provide location-based audio playback during tours. You must grant location permission in your browser for this feature to work. GPS accuracy varies by device, environment, and conditions.
Important: Roamer is a supplementary guide. GPS signals can be inaccurate, especially in urban areas with tall buildings. Do not rely solely on the app for navigation. Always be aware of your surroundings, follow local traffic laws, and use common sense when walking.
7. Limitation of Liability
Roamer provides self-guided walking tours for informational and entertainment purposes. You use the platform and participate in tours entirely at your own risk.
To the fullest extent permitted by applicable law, Roamer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:
- Your use of or inability to use the platform or tour content.
- Personal injury, property damage, or any harm sustained while following a tour route.
- Inaccurate GPS positioning, map data, or route directions.
- Unauthorized access to or alteration of your data or account.
- Service interruptions or technical failures.
You are solely responsible for your personal safety during any walking tour. Be aware of traffic, uneven terrain, weather conditions, and local hazards at all times.
8. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Scrape, copy, or redistribute tour content without permission.
- Interfere with the proper functioning of the platform.
- Circumvent payment mechanisms or access controls for premium content.
9. Termination
We may suspend or terminate your access to the platform at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users or the platform.
You may stop using the platform and delete your account at any time. Upon termination, your right to access premium content may be revoked. Sections of these terms that by their nature should survive termination (such as intellectual property, limitation of liability, and dispute resolution) will continue to apply.
10. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the platform after changes are posted constitutes your acceptance of the revised terms. If you do not agree with the changes, you should stop using the platform.
11. Governing Law
These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these terms or your use of the platform shall be resolved in accordance with applicable law and in a court of competent jurisdiction.
